Brett D. Fallon focuses his practice on bankruptcy transactions and litigation. Mr. Fallon has represented the full range of parties in bankruptcy proceedings including debtors, creditors' committees, individual creditors and parties purchasing assets out of bankruptcy. Individual creditor representations have included landlords, equipment lessors, financial institutions, contractors, service providers, insurers and vendors in large complex bankruptcy cases.
Mr. Fallon brings to his practice nearly twenty years of broad litigation experience on a wide range of bankruptcy, corporate and commercial issues. Among the numerous matters Mr. Fallon has litigated, over 50 have resulted in court decisions published in the official reporters, Lexis or Westlaw. In the last five years alone, Mr. Fallon has handled literally hundreds of preference and/or fraudulent conveyance matters. Representative recent bankruptcy cases include:
Mr. Fallon is admitted to practice in Delaware and Pennsylvania. Mr. Fallon is a member of the American Bar Association where he has held numerous leadership positions including serving as a Fellow of the Business Law Section and as Vice Chair of Subcommittees of the Business Bankruptcy Committee. Mr. Fallon has also served as a frequent speaker and program organizer. He was recently named to the Advisory Board of the American Bankruptcy Institute Mid-Atlantic Bankruptcy Workshop. Mr Fallon was also a member of the Executive Council of the Young Lawyers Division of the American Bar Association. Mr. Fallon is a member of the Delaware State Bar Association where he has served as a member of the Executive Committee and as a two-time Chair of the predecessor to the Young Lawyers Section.
Mr. Fallon received a B.A. in 1983 from Duke University, summa cum laude and was elected to Phi Beta Kappa. He received his J.D. with honors in 1986 from Duke University Law School where he was Administrative Editor of Law & Contemporary Problems.
