Morris James is a pioneer in Alternative Dispute Resolution (ADR). We know our clients want to save time and money when resolving their disputes. That is why we are committed to ADR. Our attorneys have been trained as mediators by the Delaware Superior Court and have participated in all forms of ADR, including mediations, arbitrations and mini-trials. We have devised several methods to encourage the use of ADR, including special contract provisions that qualify under the recently enacted Delaware Voluntary Mediation Act, which, for the first time, permits businesses to require pre-suit mediation of significant disputes.
Edward M. McNally is the principal drafter of the Delaware Voluntary Mediation Act. James W. Semple, Edward M. McNally and Francis J. Jones are trained and certified by the Delaware Superior Court as mediators. Mr. Semple has been trained in the arbitration of international insurance and reinsurance disputes. Mr. Jones is frequently selected as an arbitrator in the personal injury area. Among the many cases we have successfully handled using ADR techniques are disputes involving complex corporate and fiduciary duty claims, major commercial litigation claims, fradulent coveyance claims, a major federal Superfund case, environmental and products liability insurance coverage disputes and hundreds of other disputes involving contract and personal injury claims.
