Delaware Family Court Issues Guidance for Interstate Families

Family Law Group of Morris James LLPOn March 29, 2020, Governor John Carney issued a Seventh Modification to the COVID-19 State of Emergency Declaration. The modification directs all out-of-state travelers to Delaware to self-quarantine for 14 days.

In response, the Delaware Family Court issued the following guidance with regard to custody and visitation orders. 

  • All existing Delaware Family Court orders remain in full force and effect. 
  • All travel for the purposes of complying with a Family Court order is deemed essential and excluded from the self-quarantine requirement.

We recommend all families traveling interstate in accordance with a Family Court order to travel with a copy of the order to present to authorities if needed.
