If You Think You Are "Fully Insured" When It Comes to Auto Insurance, Think Again

Over the years of handling motor vehicle accident cases, some clients will report they have nothing to worry about since they are “fully insured”. Being fully insured only means you have the various types of coverages needed to legally take to the highways, such as liability coverage and personal injury protection (PIP) for your own medical bills and lost wages. However, the most crucial consideration is how much coverage you have and whether you have opted to protect yourself with uninsured and underinsured motorist coverage (UM/UIM).
You should protect yourself with the highest level of liability coverage you can afford. The greater your liability coverage, the greater the protection of your personal assets. Also, the amount of your liability coverage in Delaware is directly tied to the amount of coverage available to you for UM/UIM protection. UM/UIM coverage must be offered, but you may reject it. It is highly recommended you choose to protect yourself with UM/UIM coverage.
UM coverage protects you in the event you are injured by an uninsured driver, and UIM protects you when the at-fault driver is “underinsured” in comparison to the value of your injuries. It is the only way to hedge your bet against the possibility of you or your family being harmed by a driver with either no insurance, or the bare minimum insurance required by law.
Under Delaware law, UM/UIM coverage cannot exceed the amount of your liability coverage. Do yourself and your family a big favor and maximize your UM/UIM protection by maximizing your liability coverage. You will be grateful you did!
