Overview
Morris James advises and represents boards of directors, special committees, independent directors, managers, indenture trustees and other entities and persons in matters regarding distressed entities, including fiduciary duties, insolvency, bankruptcy, liquidation, reorganization, assignments for the benefit of creditors, receiverships and other matters relevant to distressed or failing entities.
Recent representations have included advising a special committee through a pre-packaged reorganization, advising independent managers on their fiduciary obligations regarding potential bankruptcy filings and throughout the chapter 11 process, and representing indenture trustees through restructurings in the energy, telecommunications and steel industries.
